If there are any terms in this privacy policy that you do not agree with, please discontinue the use of our Apps and ours services. This privacy policy applies to all information collected through our mobile application and website, ("Apps"), and/or any related services, sales, marketing, or events (we refer to them collectively in this privacy policy as the "Services").

1. WHAT INFORMATION DO WE COLLECT? 

Personal information you disclose to us

In Short: We collect personal information that you provide to us such as name, address, contact information, passwords, and security data. We collect personal information that you voluntarily provide to us when registering at the Apps, expressing an interest in obtaining information about us or our products and services, when participating inactivities on the Apps (such as posting messages in our online forums or entering competitions, contests or giveaways) or otherwise contacting us.

The personal information that we collect depends on the context of your interactions with us and the Apps and Services, the choices you make and the products and features you use. The personal information we collect can include the following:

Personal Information Provided by You.  We collect your name, email address, phone number, and mailing/billing addresses. We will collect information that you elect to provide to us while using the Apps. Specifically, if you elect to invite your friends to join our online community the Apps will access the contact information associated with your friend including their name, mobile phone number and email address. Refer to our Terms of Service for additional details.

Communication Information. We may collect information when you contact us with questions or concerns and when you voluntarily respond to questionnaires, surveys or requests for market research seeking your opinion and feedback.

Photos.  You may use the App to post photographs to the social profiles of other users.  Those photos may contain your personal information, such as full-face images or other personal information that may be captured in the photo.

Credentials. We collect passwords, and similar security information used for authentication and account access.

Social Media Information. We maintain a social media presence on platforms like Instagram, Tiktok, Twitter, and LinkedIn (“Social Media Pages”). When you interact with us on social media, or with our partners we may receive personal information that you provide or make available to us based on your settings, such as your contact details. In addition, the companies that host our Social Media Pages may provide us with aggregate information and analytics regarding the use of our Social Media Pages. We may also receive information from social media platforms if you link your social media accounts with your It's Good Group, Inc account. The type of information we receive depends on your settings with the relevant platform, but may include things like your handle and followers list.

All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information - such as IP address and/or browser and device characteristics - is collected automatically when you visit our App or Website.

Information about how you use our Apps, such as the types of content that you view or engage with, the features you use, the actions you take, and the time, frequency, and duration of your activities. The Website uses a tool called “Google Analytics” to collect information about use of the Website. Google Analytics collects information such as how often users visit this Website, what pages they visit when they do so, and what other websites they used prior to coming to this Website. We use the information we get from Google Analytics to maintain and improve the Website and our products. We do not combine the information collected through the use of Google Analytics with personal information we collect. Google’s ability to use and share information collected by Google Analytics about your visits to thisWebsite is restricted by the Google Analytics Terms of Service, available at https://marketingplatform.google.com/about/analytics/terms/us/, and the Google PrivacyPolicy, available at http://www.google.com/policies/privacy/. We also collect personal information such as your email address and your user activity through the use of Mixpanel. Mixpanel’s ability to use and share information is governed by the Mixpanel Terms of Use, available at https://mixpanel.com/terms/, and the Mixpanel Privacy Policy, available at https://mixpanel.com/privacy/. Online Identifiers. We collect devices; tools and protocols,such as IP (Internet Protocol) addresses; cookie identifiers, or others such as the ones used for analytics and marketing; device's geolocation; and other similar data.

 

Information collected through our Apps

In Short: We may collect information regarding your geo-location, mobile device, push notifications, when you use our apps.

If you use our Apps, we may also collect the following information:

Geo-Location Information. We may request accessor permission to and track location-based information from your mobile device,either continuously or while you are using our mobile application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device's settings.

Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device's camera, microphone, contacts, storage, notifications, sensors, and other features. If you wish to change our access or permissions, you may do so in your device's settings. 

Mobile Device Data. We may automatically collect device information (such as your mobile device ID, model and manufacturer), operating system, version information and IP address.

Push Notifications. We may request to send you push notifications regarding your account or the mobile application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device's settings.

Cookies, which are text files stored on your device to uniquely identify your browser or to store information or settings in the browser to help you navigate between pages efficiently, remember your preferences, enable functionality, help us understand user activity and patterns, and facilitate online advertising. 

Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.

Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.

 

2. HOW DO WE USE YOUR INFORMATION?

In Short: We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected via our Apps and Website for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

We use the information we collect or receive:

Service Delivery, including to:

  • Provide, operate, maintain, and secure the Service;

  • Create, maintain, and authenticate your account;


Communicating with You, including to: 

  • send you updates about administrative matters such as changes to our terms or policies; and

  • provide user support, and respond to your requests, questions and feedback.


Service Improvement, including to: 

  • improve the Service and create new features; 

  • personalize your experience; and 

  • create and derive insights from de-identified and aggregated information. 

Request Feedback. We may use your information to request feedback and to contact you about your use of our Apps.

To invite your friends to join the community. If you elect to do so, we will use contact information you have stored in your contacts about your friends in order to invite them to download the Apps. Specifically, we will use your friends name, email address and mobile phone number. Refer to our Terms of Service for additional details.

To enable user-to-user communications. We may use your information in order to enable user-to-user communications with each user's consent.  For example, we offer private messaging and group chats among persons associated with a photo.

To enforce our terms, conditions and policies for Business Purposes, Legal Reasons and Contractual.

To respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.

To manage user accounts. We may use your information for the purposes of managing our account and keeping it in working order.

For other Business Purposes. We may use your information for other Business Purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Apps, products, marketing and your experience. We may use and store this information in aggregated and anonymized form so that it is not associated with individual end users and does not include personal information. We will not use identifiable personal information without your consent.

Marketing and Advertising, including for:

Direct Marketing. To send you marketing communications, including notifying you of special promotions, offers and events via email and other means; and

Interest-Based Advertising. We engage advertising partners, including third party advertising companies and social media companies, to display ads on the Service and other online services. These companies may use cookies and similar technologies to collect Internet Activity Information over time across the Service, our communications, and other online services, and use that information to serve online ads that they think will interest you. This is called interest-based advertising. We may also share information about our users with these companies to facilitate interest-based advertising to similar users (known as a “lookalike audience”) on other online platforms. We will only use your personal information when the law allows us to. Most commonly, we will use your Personal Information in the following circumstances:

·  Where we need to perform the contract we are about to enter into or have entered into with you.

·  Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

·  Where we need to comply with a legal obligation.

Note that we may process your personal information for more than one lawful ground depending on the specific purpose for which we are using your data.

If you are based outside the United States, please note that the personal information that you provide through the App is transferred to the United States (where privacy laws may not be as adequate as in your jurisdiction) to Company and third parties engaged by Company to assist in operation of the App or provide a service to you. By using the App, you expressly agree to the transfer of the personal information to the United States.

 

3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

In Short: We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations. We may process or share data based on the following legal basis.

To Third Parties Assisting in Our Operations. Company may share your Personal Information under confidentiality agreements with other companies that work with, or on behalf of, Company to provide products and services, such as a cloud hosting company or identity verification service. These companies may use your personal Information to assist Company in its operations. However, these companies do not have any independent right to share this information.

Consent. We may process your data if you have given us specific consent to use your personal information in a specific purpose.

Legitimate Interests. We may process your data when it is reasonably necessary to achieve our legitimate business interests.

Performance of a Contract. Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.

Service Providers, including hosting services, email services, advertising and marketing services, payment processors, customer support services, and analytics services. We take commercially reasonable steps to ensure our service providers adhere to the security standards we apply to your personal information.

Professional Advisors, such as lawyers and accountants, where doing so is necessary to facilitate the services they render to us. 

Government Authorities, where required to do so for the Compliance and Protection purposes described above.

Affiliates: We may share personal information with our current and future affiliates, meaning an entity that controls, is controlled by, or is under common control with It's Good Group, Inc. Our affiliates may use the personal information we share in a manner consistent with this Privacy Policy.

Legal Obligations. We may provide information about you to respond to subpoenas, court orders, legal process or governmental regulations, or to establish or exercise our legal rights or defend against legal claims. We believe it is necessary to share information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by law. In such circumstances, we will take appropriate measures to ensure that the requester understands the sensitive nature of the Personal Information that they may receive.

Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud,situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

More specifically, we may need to process your data or share your personal information in the following situations:

Business Transaction Recipients, such as counterparties and others assisting with a merger, acquisition, financing, reorganization, bankruptcy, receivership, dissolution, asset sale, or similar transaction, and with successors or affiliates as part of or following that transaction.

Third-Party Advertisers. We may use third-party advertising companies to serve ads when you visit the Apps. These companies may use information about your visits to our Website(s) and other websites that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you.

Other Users. When you share personal information (for example, by posting comments, contributions or other content to the Apps) or otherwise interact with public areas of the Apps, such personal information may be viewed by all users and may be publicly distributed outside the Apps in perpetuity. Similarly, other users will be able to view descriptions of your activity, communicate with you within our Apps, and view your profile.

 

4. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax,accounting or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than the period of time in which users have an account with us.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

 

5. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We use appropriate security measures preventing yourPersonal Information from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our Apps is at your own risk. You should only access the Services within a secure environment.

 

6. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: In some regions, such as the European Economic Area, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at anytime.

In some regions (like the European Economic Area), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information,(ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. To make such a request, please use the contact details provided below. We will consider and act upon any request in accordance with applicable data protection laws.

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal.

If you are resident in the European Economic Area and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. Account Information

If you would at any time like to review or change the information in your account or delete your account, you can:

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us at support@itsgood.life. You will then be removed from the marketing email list - however, we will still need to send you service-related emails that are necessary for the administration and use of your account. 


7. DATA BREACH

A privacy breach occurs when there is unauthorized access to or collection, use, disclosure or disposal of personal information. You will be notified about data breaches when It’s Good Group Inc. believes you are likely to be at risk or serious harm. For example, a data breach may be likely to result in serious financial harm or harm to your mental or physical well-being. In the event that It’s Good Group Inc. becomes aware of a security breach which has resulted or may result in unauthorized access, use or disclosure of personal information It’s Good Group Inc. will promptly investigate the matter and notify the applicable Supervisory Authority not later than 72 hours after having become aware of it, unless the personal data breach is unlikely to result in a risk to the rights and freedoms of natural persons.

 

8. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. Assuch, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy policy.

 

9. CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS

In Short: Yes, if you are a resident of California, you are granted specific rights regarding your personal information.

If you are a California resident, California law provides you with the following rights with respect to your personal information:

The right to know what personal information we have collected, used, disclosed and sold about you during the preceding 12 months, as described above in the Section “What Information Do We Collect?” To submit a request to know, email support@itsgood.life.

The right to request that we delete any personal information we have collected about you. To submit a request for deletion, do so within the app or email us at support@itsgood.life.

When you exercise these rights and submit a request to us, we will verify your identity by asking you to log in to your account if you have one with us.  If you do not have an account with us, we may ask for additional information to verify your identity.  We also may use a third party verification provider to verify your identity. 

Your exercise of these rights will have no adverse effect on the price and quality of our goods or services.

 

10. LINKS TO THIRD PARTY WEBSITES

As a convenience to our users, the Apps and Services may contain links to other websites that we believe may offer useful information. As stated in more detail in the Terms of Service, the terms of usage and other conditions of use posted on those sites, and not the policies and procedures we described here, apply to those sites. Your linking to any other websites is at your own risk, and you are responsible for learning about and complying with the terms of usage and other conditions posted on those websites.

 

11. CHILDREN’S PRIVACY

Under Age 13. We understand the importance of protecting children's privacy in the interactive online world. The Apps and the Services are not designed for, or intentionally targeted at, children under 13 years of age. It is not our policy to intentionally collect or maintain information about anyone under the age of 13.  No one under the age of 13 should submit any Personal Information to Company, the Apps or the services.

Under Age 18. Minors under 18 years of age may have the personal information that they have provided to Company through the Website deleted by visiting this link.  Please note that, while we make reasonable efforts to comply with such requests, the deletion of your personal information does not ensure the complete and comprehensive removal of that data from all systems.

 

12. DO WE MAKE UPDATES TO THIS POLICY?

In Short: Yes, we will update this policy as necessary to stay compliant with relevant laws.

The Service and our business may change from time to time. As a result we may change this Privacy Policy at any time. When we do we will post an updated version on this page, unless another type of notice is required by applicable law. By continuing to use our Service or providing us with personal information after we have posted an updated Privacy Policy, or notified you by other means if applicable, you consent to the revised Privacy Policy and the practices described in it.
